Young Professional Woman Charged with Driving Under the Influence (DUI) of Alcohol After a Single-Vehicle Accident: Dismissed.
Police received a 911 call from an unidentified motorist who claimed to observe a vehicle veer off the roadside while negotiating a sharp turn, crash through a fence and bound into a parking lot. Police responded to the area and came upon a single vehicle accident matching the caller’s description. The vehicle contained three female occupants: one in the driver’s seat, one in the front passenger’s seat and the third in the back seat. Officers questioned the women on scene about what had occurred. The passengers both identified the driver, described that she lost control of the vehicle and veered off the road, thru the fence and into a parking lot. These passengers also reported personal injuries and requested medical attention. They appeared to be under the influence of alcohol due to the odor on their breath, slurred speech, blood shot eyes and unsteadiness on their feet. The driver admitted to consuming alcohol, mumbled her words, appeared disoriented and also under the influence of alcohol. She then failed to series of field sobriety tests and refused to submit to a chemical breath test. She then requested medical attention. Based on these facts, she was arrested and charged with DUI.
The young woman had no criminal record, an excellent driving record, had just graduated from college and was about to assume a prestigious position with a corporate accounting firm. Fearful that her recent arrest and charge could cost her this job, she retained Attorney John L. Calcagni III to represent her in this criminal matter.
