Warwick Resident vs State Senator: Assault Allegation Case Overview

Case Overview:
Foster Police responded to an allegation of simple assault made against a resident of the town, by the Town Manager. The manager also serves as a Rhode Island State Senator. This man and the resident have an ongoing, acrimonious relationship. According to the resident, the town manager repeatedly harasses him. One day, the resident departed from his home in a vehicle and was traveling down the street that was undergoing road repair. The manager was present on site. He took out a cellphone and began filming the resident, while making derogatory remarks. The town resident stopped the car, rolled down the window, and knocked the phone out of the manager’s hand. He then drove off and went about his business. Embarrassed by the incident, which occurred in front of several public works road repair workers, the manager called Foster Police, and pressured them to criminally charge the resident. Upon learning of a warrant for this arrest, the resident hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, the defend him in this matter.
Case Result: One-Year Filing.
Attorney Calcagni surrendered the man to police and coordinated his immediate release on bail. Even the officers were sympathetic to the resident’s situation. Once in Court, Attorney Calcagni persuaded the prosecution to file this case for one year. Providing the man (who had no criminal history) is not charged with another crime during the filing period, the matter will be eligible for expungement after the passage of 12 months.
