Shoplifting and Conspiracy to Commit Shoplifting
An adult mother and her minor daughter were both arrested and charged with Shoplifting and Conspiracy to Commit Shoplifting. The duo entered a retail department store. Loss prevention agents working for the store observed them on video surveillance attempt to conceal merchandise on their persons and inside their bags. Agents also observed the daughter exchange her footwear for new footwear that she selected from the store shelves. The mother and daughter then attempted to leave the store without rendering payment. Agents detained the mother and daughter before they existed the building and notified police. Police were notified and responded to the scene. Police took the mother and daughter into custody and searched their persons resulting in discovery of merchandise valued at nearly $200.00. During questioning by police, the mother provided a confession to not only intentionally shoplifting in this instance, but also having done so on multiple occasions in the past with her daughter. Mom admitted that prior shoplifting incidents occurred at multiple retail stores in the area. Based on the overall investigation of this particular theft, the mother was charged in adult court with Shoplifting and Conspiracy to Commit Shoplifting while her young daughter was charged with identical offenses in the juvenile court.
Mom and daughter retained Attorney Calcagni to represent in connection with their respective matters. He successfully negotiated with prosecutors for dismissal of both cases.
