Case Overview:
Two neighbors had a longstanding feud. The men did not get along, and often taunted each other verbally. One day they found themselves both outdoors in their front yards. One man was performing yard work. When the next-door neighbor taunted him, the man walked over and struck him in the head with a leaf blower. This blow inflicted serious injury to the man, resulting in him to undergo medical treatment in the form of staples to suture the wounds. The aggressor left the area before police and rescue workers arrived on scene. Some days later, while seeking to enforce a warrant for this man’s arrest, police came upon him and conducted a motor vehicle stop. After taking the man into custody on assault charges, officers performed an inventory search of his car. Inside they discovered over $28,000.00 and a large quantity of counterfeit Percocet pills that had been manufactured with Fentanyl. The man was ultimately charged in Rhode Island Superior Court with Felony Assault, Possession with Intent to Deliver Fentanyl, and Disorderly Conduct. He hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 8-Year Suspended Sentence with Probation.
The prosecution advocated aggressively for jail sentence, which Attorney Calcagni equally opposed. Unable to reach an agreement, the case was scheduled for trial. In the interim, the man underwent extensive substance abuse, mental health, and anger management counseling programs, all of which he successfully completed. Attorney Calcagni used this information to successfully convince the trial judge on the eve of jury selection to offer his client a suspended sentence, in exchange for his acceptance of responsibility. The man accepted the Court’s offer and avoided both a trial and the risk of jail, if convicted.
