Case Overview
Providence Police were dispatched to a neighborly dispute over placement of a fence. While in route, dispatch advised that the situation had escalated into a physical altercation. Police spoke with the first neighbor, who was visibly injured. He admitted to removing part of the fence to gain access to his garage When the second neighbor noticed this, he confronted him and a verbal dispute ensued. The first neighbor began video recording, which upset the second neighbor. The physical assault occurred when the second neighbor attempted to gain possession of first neighbor’s cellphone. Based on his information, police arrested the second neighbor and charged with Felony Assault on Person Over Age 60 Causing Bodily Injury. Coincidentally, the second neighbor was also over age 60. In any event, the man retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend this matter.
Attorney Calcagni successfully caused his client to be accepted to the Rhode Island Superior Court Adult Diversion Program. The program lasts for a period of up to one year. Providing the man is not charged with a new offense and completes all terms of his Diversion Program Participation Agreement, the case will be both dismissed and sealed in the end. As part of his participation, the man was required to complete community service and make a financial contribution to Violent Crimes Indemnity Fund (“VCIF”). Six (6) months later, the Court rewarded the man with early graduation from the program. His case was then dismissed and sealed from his record leaving him with a clean criminal history free from any convictions.
