Federal Child Pornography Case in Providence

Case Overview:
Federal law enforcement agents from the Department of Homeland Security Investigations (HSI) executed a search warrant at man’s Providence home, seeking digital devices capable of storing files consisting of child pornography. Agents identified the man following another child pornography investigation in Arizona, to whom the man had allegedly been distributing his illicit images and videos. Inside a crawl space inside the man’s attic, agents located two hidden iPhones that captured their attention. A digital forensic analysis of the devices’ contents yielded the discovery of 600 images and videos of child pornography. The man was arrested and charged in United States District Court for the District of Rhode Island. He hired Federal Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 60 Months Incarceration with Supervised Release.
Attorney Calcagni first worked to get the man released on bail. He also successfully defended the man in two, bail violation hearings. Upon the third bail violation, the Court revoked the man’s bond. He ultimately admitted guilt to the federal child pornography offenses, where by faced a mandatory minimum jail sentence of 60 months or 5 years and a maximum punishment of 20 years. At sentencing, his advisory U.S. Sentencing Guidelines Range was 151 -188 months of incarceration. The government argued for a guidelines sentence. Attorney Calcagni opposed this request and recommended the mandatory minimum term of 60 months, which the Court accepted and imposed.
