Case Overview
East Greenwich Police were on routine patrol when they observed a vehicle drifting into the opposite lane of travel and then jerk back into its original travel lane. Police activated their overhead lights and traffic initiated a stop of the vehicle. Officers observed the female operator to have bloodshot, watery eyes and slurred speech. Officers also detected a strong order of an alcoholic beverage on her breath. Officers then conducted a series of Felid Sobriety Tests on the operator, which she failed. She also refused to provide police with a breath sample. Thereafter, the woman was arrested and charged with the misdemeanor crime of Driving Under the Influence (DUI) of Alcohol in Rhode Island District Court and the civil offense of Refusal to Submit to a Chemical Test and multiple traffic infractions in the Rhode Island Traffic Tribunal. The woman retained RI DUI Lawyer, John L. Calcagni III, to defend her in these matters.
She was especially considered with a criminal conviction because she hold a Registered Nursing License with the Rhode Island Department of Health, and is also an enlisted Soldier in the Rhode Island Army National Guard. After appearing on the woman’s behalf for multiple pretrial conferences, Attorney Calcagni persuaded prosecutors to dismiss the woman’s criminal charge in exchange for her acceptance of responsibility to the civil offense of Refusal to Submit to a Chemical Test in Rhode Island Traffic Tribunal. The criminal case was sealed from public record and this disposition should have no adverse impact on the woman’s health care and military careers.
