Richmond Police were dispatched to The Preserve, a luxury hotel and resort located in Richmond, RI, for report of a domestic disturbance. When they arrived, police learned from a father that his adult son became violent in their suite, destroying property, acting violently, and even assaulted his own father. The family was in the United States visiting from Denmark, and stopped in Rhode Island while on the trip to visit some friends. Based on the father’s report, police arrested and charged him the man Domestic Vandalism, Domestic Disorderly Conduct, and Domestic Simple Assault in Rhode Island District Court (4th Division). He was arraigned and released by a Justice of the Peace. He then left Rhode Island and went to a mental health treatment facility in Colorado, before the family concluded its travels and returned abroad. Once back in Denmark, the man hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend his son in this matter.
The man had no criminal record and had a history of mental health problems, for which he was in treatment. Attorney Calcagni presented this information, along with supporting documentation to prosecutors for the Town of Richmond. Over time, Attorney Calcagni successfully advocated for the dismissal of this case in his client’s absence. The case was subsequently sealed, leaving the man with a clean criminal history.
