Domestic Simple Assault: Dismissed and Sealed
Two adult siblings got into a physical altercation in a hospital emergency room. The men’s parent fell ill resulting in her being taken to the hospital. The estranged brothers had not seen one another in a long period of time prior to reuniting at their
mother’s hospital bedside. A verbal argument ensued which escalated into a physical altercation. The fight was broken up by hospital staff and both men were involuntary escorted off of the premises. The aggressor brother who initiated the fight later
filed a complaint with police against his brother. This resulted in a warrant for his arrest and a charge of Domestic Simple Assault.
The defendant’s brother retained Attorney John L. Calcagni III to represent him against this trumped up charge and in connection
with a self-defense claim against his older brother. Attorney Calcagni conducted his own investigation of this matter, which included interviewing eyewitnesses who confirmed the complaining brother was the aggressor and that the defendant had acted solely
in his own defense. Based on these efforts, Attorney Calcagni successfully convinced the prosecutor to dismiss the case and its charge against his client. The case has since been sealed resulting in no judicial or law enforcement of this incident.
