Disturbing the Peace and Destruction of Property
An intoxicated female got herself into some trouble with police while visiting her boyfriend’s apartment building. The female had allegedly consumed too much alcohol along with her prescription medication rendering her in an apparent state of intoxication. After being locked out of her boyfriend’s apartment, she began hitting and kicking the apartments doors of both the boyfriend and many of his neighbors. Some of the doors were damaged from the female allegedly banging on the door with a kitchen pan. An unidentified person contacted police who arrived on scene, observed the female to be intoxicated, retrieved statements from some of the disturbed neighbors and observed physical damage to several apartment doors. The female was arrested and charged with Disturbing the Peace and Destruction of Property. The female had no criminal record, was educated and professionally employed and had a sibling who was an attorney. She went to her sibling for guidance. The attorney referred her sister to Attorney John L. Calcagni III. Upon being retained, Attorney Calcagni developed his own strategy and pretrial investigation by which to get this case and its charges dismissed. He interviewed the female’s boyfriend and her allegedly disturbed neighbors. Attorney Calcagni also coordinated to have the physical damage to any apartments and/or apartment doors quickly repaired. He then obtained affidavits from each resident in favor of dismissing charges against the female. Based on these collective efforts, Attorney Calcagni’s plan worked in that he successfully convinced the District Attorney’s Office to dismiss the case prior to arraignment resulting in no criminal record whatsoever for his client.
