Case Overview
East Providence Police responded to a call for service regarding a child left alone in a vehicle. Upon arrival, officers met with the caller and child. The caller stated that she was walking down the street when she heard the child crying and yelling for its mother. After attempting and failing to locate the child’s guardian, the caller removed the child from the vehicle and contacted police. Police located the mother of the child, questioned her about the incident, and reunified the woman with her child. Based upon the facts and circumstances, police request an arrest warrant for the woman for Child Endangerment. The woman retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend this matter.
After ensuring his client was cleared by the Department of Children, Youth, and Families (DCYF), Attorney Calcagni immediately referred the matter to the Rhode Island Superior Court’s Adult Diversion Program. The program lasts for a period of up to one year. After negotiating with the prosecutor and judge, Attorney Calcagni successfully secured the woman’s acceptance to the program. The woman successfully graduated from the program early. Her case was then dismissed and sealed, leaving her with a clean criminal history free from any convictions.
