A stepfather and stepson had a family dispute over another relative who suffered from a substance abuse addiction. After the relative’s recent overdose, the stepson first alleged that his stepfather enabled the family member and then physically attacked him. The stepson struck his stepfather’s head on a wall during the altercation, resulting in physical injury and a concussion. Police were notified resulting the stepson’s arrest. The stepfather also received medical treatment for his injuries. The stepson, an insurance professional and aspiring police officer, retained Rhode Island Criminal Defense Lawyer, John L. Reduced to Misdemeanor Simple Assault and Filed. As time passed, he recruited the stepfather’s support to have the legal charges dismissed. Both men also wanted to reconcile. Attorney Calcagni ultimately negotiated with the prosecution for a pretrial resolution of the case. The deal provided for an amendment or reduction of the charged felony to a misdemeanor. The man admitted nolo contendere to the reduced charge and the matter was filed for one year. Provided he is not charged with a new offense during this period, the matter will be eligible to be sealed from his personal criminal history and overall public record.
