Central Fall RI Felony Assault Case

Case Overview:
A man got into a heated verbal exchange with his mother’s boyfriend. The two men did not have the best relationship, so verbal arguments were not uncommon between them. On one occasion, things really escalated. As their argument progressed and intensified, the man took out a pocket knife and suddenly stabbed the elder boyfriend in the neck. The man’s mother called 911, which resulted in a response by police and rescue workers. The man’s mother told police what she observed, without realizing the ramifications it would have on her son. The boyfriend did the same. As a result, the man was arrested and charged in Rhode Island Superior Court with Assault with Intent to Commit Specified Felonies and Felony Assault. He retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: 5 Years in the ACI, All to Be Suspended with Probation.
As time passed, the boyfriend did not want to participate in the prosecution. He made a full medical recovery and signed an affidavit of non-prosecution with Attorney Calcagni’s office. However, this did not dissuade prosecutors from moving forward. The Court set a trial date. As jury selection approached, Attorney Calcagni successfully negotiated a pretrial resolution of this case that called for his client’s admission of guilt to felony assault in exchange for a suspended sentence.
