Assault with Intent to Murder and Assault with a Dangerous Weapon: Dismissed
Two men got into a verbal altercation, which turned life threatening regarding their prior business dealings. The incident began with one of the men sitting alone at the bar of a restaurant. His former partner walked in with an entourage of friends and approached him. The former partner initiated the argument with the man sitting alone. The incident escalated into a physical altercation when the former partner, who with his friends surrounded the man at the bar, struck him in the face. The man at the bar responded by pulling out a knife, stabbing the aggressor in the stomach and hastily walking out of the restaurant to his bar and fled the scene. The stabbing blow initially stunned the man. After realizing he had been stabbed and was bleeding, he went to the hospital for treatment. Doctors admitted the injured man and performed surgery to repair the stab wound to his stomach.
While in the hospital, police confronted the man about the cause of his injury. He first provided an untrue statement, but he later changed the statement to implicating his former partner for the stabbing. Based on this allegation and corroborating injury, police went to the bar to conduct an investigation by interviewing potential witnesses. The man who fled the scene was ultimately arrested and charged with both Assault with Intent to Murder and Assault with a Dangerous Weapon. The man, who was believed to hard organized crime ties, retained Attorney John L. Calcagni for his legal defense. Attorney Calcagni initiated his efforts in this case by investigating the alleged victim’s background.
The individual has how own criminal history in both the state and federal systems. He also had a bad reputation in town, and among the members of the court system. Attorney Calcagni attempted to reach out the victim directly to inquire about his medical bills for care and treatment received in the hospital. He learned that the bills estimated at $30,000.00 and that the victim had retained legal counsel for representation in this matter. Attorney Calcagni, advocating for his client, and the victim’s lawyer engaged in negotiations for an out-of-court resolution of this matter. After months of negotiations, the parties finally struck deal that provided for dismissal of all criminal charges against the man who had performed the stabbing. The case and its charges have since been dismissed and are eligible to be sealed and removed from the man’s record.
