Rhode Island District Court (6th Division)
Case Overview:
Providence Police responded to a local Walmart for a report of shoplifting. Upon arrival, officers met with the store’s loss prevent agents who caught a young man and his girlfriend shoplifting. The couple entered the store, filled a shopping carriage with various items, and replaced the tags on the more expensive products with tags from less expensive products, in order to avoid paying the required sales prices. The couple then attempted to pass the point of sale at the cash register. Their conduct was captured on video surveillance. Loss prevention agents detained them and contacted police. As a result, both the man and the woman were arrested and criminally charged with misdemeanor shoplifting. They hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend them.
Case Result: Charges Dismissed and Cases Sealed.
The young man was a U.S. Marine on active duty stationed in Rhode Island. His girlfriend worked as a nurse. The two faced adverse employment consequences if convicted of a crime. Attorney Calcagni obtained mitigation regarding their work, education, and more, which he presented to the judge and city prosecutors. Using this information, Attorney Calcagni successfully advocated for the dismissal of the couple’s charges in exchange for their performance of community service. The cases were then sealed from public record.
