Case Overview
Coventry Police responded to Newport Creamy for a report of a cellphone located inside the man’s bathroom. Upon arrival, police met with the caller who reported that he noticed a cellphone on the left side of the toilet, which he believed was recording. The man stated that he picked up the phone and brought it to manger on duty who, attempted to unlock it and triggered a factory re-set of the device. Police seized the phone and obtained a search warrant to perform a forensic analysis of the device. The investigation revealed that the phone was both owned by and registered to the restaurant manager. Based on these facts, Coventry Police arrested and charged the man with Video Voyeurism and Obstructing a Police Officer. He retained Rhode Island Criminal Defense Attorney, John L. Calcagni III, to defend him in this matter. Following ongoing discussions with the State, Attorney Calcagni successfully convinced prosecutors and the Court to spare the man from jail. In exchange for the man’s acceptance of responsibility to one of the charged offenses, Attorney Calcagni successfully negotiated for him to serve 12 months on home confinement, followed by a term on probation, opposed to being sent to the Adult Corrections Institute (ACI).
