Case Overview
Scituate Police assisted a constable in his attempt to serve an eviction notice and restraining order. These order were sought by a disgruntled ex-girlfriend against her ex-boyfriend who she recently discovered was having an affair. The couple had previously lived together in the woman’s Scituate home for approximately six years. While on scene, officer discovered a very large marijuana grow, to which the disgruntled woman disclaimed all knowledge and attributed it to her ex-boyfriend. She also made allegations of domestic violence and that the man was using her car without permission. Police located the man and placed him under arrest for a variety of felony and misdemeanor charges, including 90 mature plants and 51.6 pounds of usable marijuana found inside the woman’s barn, along with more marijuana and firearms paraphernalia discovered inside her home. At his arraignment in District Court, the man was ordered held without bail. His significant other then hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter. Because the State would not agree to bail, the case progressed to an evidentiary bail hearing. After cross-examining the lead detective and submitted an extensive bail package on the man’s behalf, the Court ultimately set bail over the State’s objection in the amount of $100,000 with surety and conditions that he surrender his passport and firearm(s), if any, have no contact with his ex-girlfriend, sign a 4th Amendment Waiver, and execute a Waiver of Extradition.
