Case Overview
North Providence Police were on routine patrol when they observed a red vehicle following another vehicle at an unsafe distance. Officers stopped the red vehicle after observing it commit several more moving violations. Police approached the man operator who admitted to consuming alcoholic beverages earlier that night. Officers further observed the man to have bloodshot, watery eyes, and strong odor of an alcoholic beverage emanating from his breath, slurred speech, and to be in possession of an open contained. Officers then administered a series of Field Sobriety Tests, which the man failed. He also refused to provide a breath sample. Thereafter the man was arrested and charged with Driving Under the Influence of Alcohol in Rhode Island District Court and the civil offense of Refusal to Submit to Chemical Test and multiple traffic infractions in Rhode Island Traffic Tribunal. The man retained RI DUI Lawyer, John L. Calcagni III, to defend him in these matters.
After appearing on the man’s behalf for multiple pretrial conferences, Attorney Calcagni persuaded prosecutors to dismiss the man’s criminal charge in exchange for his acceptance of responsibility to the civil offense of Refusal to Submit to Chemical Test in Rhode Island Traffic Tribunal. The man’s criminal charges were then sealed, leaving him with a clean criminal history.
