Case Overview
Rhode Island State Police were called to investigate a black jack dealer at a local casino. The investigation, which included witness interview, video footage, and forensic accounting, revealed that the dealer was not fulfilling is roles and responsibilities as a dealer. His conduct facilitated cheating by permitted players who factually lost hands at the table to not forfeit their bets. In other instances, his conduct promoted cheating, all of which resulted in financial losses to the casino. The man was fired from casino and criminally charged in Rhode Island Superior Court. Once charged, the man no longer resided in Rhode Island and had relocated to Puerto Rico. He was unaware of the criminal charges, and only learned of them upon undergoing a routine background investigation in connection with a new job application. Upon learning of a pending warrant for this arrest and Superior Court charges, he retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
The man flew from Puerto Rico to Rhode Island. He and Attorney Calcagni appeared in Court, causing the pending warrant to be withdrawn. The man was then arraigned, pleaded not guilty, and returned home. Over time, Attorney Calcagni negotiated a favorable pretrial disposition of this matter for his client. In exchange for the man’s acceptance of responsibility to one count of engaging in a Casino Gaming Crime, the imposition of sentence was deferred for one year. Providing the man is not charged with a new offense during this time period, the case will ultimately be closed with no felony conviction or punishment and then expunged from public record.
