5-Year Suspended Sentence for Gun Charges in Providence Superior Court

Case Overview:
A Connecticut man accompanied his female friend to Rhode Island to retrieve her belongings from an apartment she had formerly shared with an ex-girlfriend. Upon arrival, the ex-girlfriend refused entry by locking the door and ignoring attempts to communicate. Frustrated, the man used his friend’s phone to Facetime the ex-girlfriend, during which he allegedly displayed a firearm in a threatening manner and demanded access to the apartment.
The ex-girlfriend contacted police, who responded to the scene. Providence Police detained the man and conducted a search of his vehicle, where they discovered a stolen, unlicensed handgun. He was arrested and charged in Rhode Island Superior Court with Carrying a Pistol or Revolver Without License, Possession of a Stolen Firearm, and Disorderly Conduct. The man hired Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to represent him.
Attorney Calcagni presented mitigation evidence to the Court highlighting the man’s positive strides in employment and education. As a result, the judge imposed a 5-year suspended sentence with probation, sparing him from incarceration.
