Cranston Police were dispatched to conduct a well-being check on an elderly woman after her adult daughter informed authorities that she had been assaulted by her adult son. The woman lived with her husband and their adult son. Upon arrival, police located the woman who confirmed her daughter’s story. Police also observed scratches on the woman’s face. The woman said she and her son had an argument, during which time he scratched her face. After speaking with the man, he confirmed his mother’s claim. Based on this collective information, the man was taken into custody and charged with the felony offense of Domestic Assault on a Person Over Age 60 in violation of Rhode Island criminal law. He was ultimately prosecuted in Rhode Island Superior Court (Providence County). The man retained Rhode Island Criminal Defense Lawyer, John L. Calcagni III, to defend him in this matter.
Case Result: Charge Amended and Filed for 6 Months.
As time passed, the mother and son reconciled. The mother also expressed her desire to have the charges dropped, and early on, persuaded a judge to vacate the no contact order that was originally imposed between them. After several conferences involving pretrial negotiations, Attorney Calcagni persuaded prosecutors to reduce the charged felony offense to the misdemeanor offense of Disorderly Conduct. He further advocated that this charge not be a domestic violence offense to enable him to avoid a no contact order with his mother, and attendance of mandated domestic violence classes. The man admitted to this lesser offense and the Court filed the case for six months. Providing the man is not charged with a new offense during this time, the case will be eligible for expungement at the end of the filing period.
