Pawtucket Sexual Assault Charges Amended

Case Overview:
A medical doctor was accused by multiple patients of sexual assault. Some patients claimed the doctor penetrated their vaginas with his fingers during medical exams. Others claimed that he groped their breasts all under the guise of administering medical care and treatment. The patients filed complaints with both the police and Rhode Island Department of Health (DOH). Following a long-term, in-depth investigation, the DOH suspended the doctor’s license. Police then arrested the doctor. He was charged in Rhode Island Superior Court (Providence County) with multiple counts of First Degree and Second Degree Sexual Assault. He retained Rhode Island Sex Assault Defense Lawyers, John L. Calcagni III and John E. MacDonald to defend him in this matter.
Case Result: Charges Amended to Felony Assault with a 6 Years Suspended Sentence.
After years of pretrial negotiations, the doctor declined a pretrial offer that called for his guilty plea in exchange for both a jail sentence and sex offender registration, and elected to proceed to trial. Within weeks of the actual trial date, Attorneys Calcagni and MacDonald persuaded prosecutors to amend the existing charges from sexual assault to felony assault, which is a non-sex offense that does not require sex offender registration. In exchange for the doctor’s plea to this amended charge, he was given a 6-year suspended sentence with probation.
